General Terms and Conditions and Consumer Information
as part of sales contracts concluded via the online shop between RoughEnd GbR – hereinafter referred to as "Seller" – and the customer – hereinafter referred to as "Customer".

§ 1 Scope and General Notes

(1) Unless otherwise individually agreed, which takes precedence over these terms and conditions, the following General Terms and Conditions exclusively apply to the business relationship between the Seller and the Customer. The inclusion of the Customer’s own terms is hereby rejected unless otherwise agreed.

(2) The Customer is a consumer if they conclude the contract for purposes that are predominantly not attributable to their commercial or self-employed professional activity. An entrepreneur is any natural or legal person or a partnership with legal capacity who acts in the course of their commercial or self-employed professional activity when concluding a legal transaction.

§ 2 Conclusion of Contract

(2) The essential characteristics of the goods are set out in the respective product description listed by the Seller.

(3) All offers in the Seller’s online shop are non-binding invitations to the Customer to submit a purchase offer to the Seller. Once the Seller has received the Customer's order, the Customer will first receive confirmation of the receipt of their order, usually by email (order confirmation). This order confirmation does not yet constitute acceptance of the order. After receiving the order, the Seller will review it promptly and confirm acceptance within 2 working days (order confirmation).
The order process in the Seller’s online shop works as follows:

(4) The Customer selects products from the Seller’s range and collects them in a virtual shopping cart using the "Add to Cart" button. By clicking on the "Cart" button, the Customer gets an overview of the selected products. Using the "Buy Now" button, the Customer submits a binding request to purchase the products in the cart.
Before sending the order, the Customer can view and change the data at any time using the browser’s back and forward buttons. The request can only be submitted if the Customer accepts these terms and conditions by clicking the checkbox "Accept Terms and Conditions".
The Seller then sends the Customer an automatic confirmation of receipt by email, listing the Customer’s order. The Customer can print this confirmation using the "Print" function. This automatic confirmation only documents that the order has been received and does not constitute acceptance. The contract is only concluded upon explicit acceptance by the Seller via a separate confirmation email.

§ 3 Subject Matter, Product Features, Delivery, Availability

(1) The subject of the contract is the goods and services specified by the Customer as part of the order and listed in the order or order confirmation, at the prices indicated in the online shop. Errors and omissions, especially regarding availability, are reserved.

(2) The properties of the goods result from the product descriptions in the online shop. Product images may differ from the actual appearance; especially colors may vary significantly for technical reasons. Images are for illustration only and may differ from the actual product. Technical data, weight, dimensions, and performance descriptions are as precise as possible but may show typical deviations. Such deviations do not constitute defects.

(3) If, at the time of ordering, the product selected by the Customer is not available, the Seller will inform the Customer of this in the order confirmation. If the product is permanently unavailable, the Seller will not issue an acceptance declaration. In this case, no contract is concluded.

(4) If the product is temporarily unavailable, the Seller will inform the Customer immediately in the order confirmation. For delivery delays of more than two weeks, the Customer has the right to withdraw from the contract. The Seller may also withdraw from the contract and will promptly refund any payments made.

§ 4 Delivery, Prices, Shipping Costs, Customs

(1) Shipment to the logistics provider occurs no later than two days after payment is received, or after the order confirmation in the case of cash on delivery. Delivery takes up to five days. Deviations are indicated on the respective product page.

(2) Delivery is only available within the EU.

(3) All prices include VAT. The stated prices are final prices plus shipping costs. The Customer will receive an invoice showing VAT.

(4) For orders shipped outside the EU, additional taxes or fees (e.g., customs duties) may apply that are not paid by us or invoiced by us but are to be paid by the Customer directly to the relevant customs or tax authorities. Please inquire at your local authorities for more details.

§ 5 Payment

Payment can be made in advance (PayPal, bank transfer), credit/debit card, invoice, or cash on delivery.

§ 6 Transport Damage

(1) If goods are delivered with obvious transport damage, the Customer is asked to immediately report this to the delivery company and contact the Seller as soon as possible.

(2) Failure to file a complaint or contact the Seller does not affect the Customer’s statutory warranty rights, but helps the Seller to assert claims against the carrier or transport insurance.

§ 7 Warranty for Defects

(1) The Seller is liable for defects in accordance with the applicable legal provisions, in particular §§ 434 ff. of the German Civil Code (BGB).

(2) A guarantee exists for the goods delivered by the Seller only if it is expressly stated in the order confirmation for the respective item.

(3) Complaints and warranty claims can be made to the address specified in the legal notice.

§ 8 Retention of Title

Until full payment has been made, the goods remain the property of the Seller.

§ 9 Liability

The statutory provisions apply.

§ 10 Contract Text

The contract text is stored in the Seller’s internal systems. The Customer can view the General Terms and Conditions in their customer account at any time. Order data and the GTC will be sent to the Customer by email. After the order is completed, the order data will no longer be accessible online for security reasons.

§ 11 Final Provisions

(1) The contract language is German.

(2) German law applies to contracts between the Seller and the Customer, excluding the UN Convention on Contracts for the International Sale of Goods. This choice of law applies to consumers only if it does not deprive them of protection afforded by mandatory provisions of the law of the state in which the consumer has their habitual residence.

(3) If the Customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships between the Customer and the Seller shall be the Seller’s registered office. This also applies if the Customer has no general place of jurisdiction in Germany or the EU, or if the Customer’s place of residence or habitual residence is not known at the time the action is brought.
